Terms and conditions
1. General

This website is owned and operated by OWI. All of the content featured or displayed on this website, including, but not limited to, text, graphics, photographs images ("content") and software is owned by OWI and its content providers.

All elements of this OWI website, including, but not limited to, the general design and the content, are protected by copyright, moral rights, and other laws relating to intellectual property rights. Except as explicitly permitted under this or another agreement with OWI, no portion or element of this website or its Content may be copied or retransmitted via any means and this website, its content and all related rights shall remain the exclusive property of OWI or its licensors unless otherwise expressly agreed.

You shall indemnify OWI against any losses, expenses, costs or damages incurred by any or all of them as a result of your breach of the terms of this agreement or your unauthorized use of the content and related rights.

OWI will periodically send email updates regarding new features or website information that may be of interest to you. If you do not wish to receive these emails, please reply to the sender and you will be removed from future lists.

OWI does not sell or rent information about our customers to any third parties. All information supplied to us, including your email address and telephone number, is used for internal purposes only, in order to keep you updated with the latest news and updated website information. We also use your account information to personalise the content and services offered to you. Your website activity is anonymously recorded in order to improve the functionality of the website and our service.

2. Usage Rights

When a feature is licensed by OWI, the usage is specified on the invoice and the feature cannot be used for any other purpose without further agreement by OWI. The license will state the media use and the territories for the usage. The licensee warrants that he shall not copy, loan, transfer, further license, sell or otherwise deal with nor permit any third party to use the material, nor purport in any way to assign the benefit of this agreement or any rights there under.

The features shall be available on a first come first served basis in respect of any particular territory.

Publication of the features shall be made once only.

3. Credits

Publication of the features must insert the following credit line "[name of Journalist and or Photographer] / OWI".

4. Translations

OWI can not guarantee that text files supplied in translation shall be entirely free from any inaccuracy and can not accept any loss or damage suffered by the customer or by any third party arising from the use of any translated material. It is the duty of the licensee to ensure that they consider the translation supplied by OWI to meet their criteria of accuracy and correct grammar.

5. Payment

Payment is due upon reception and no later than 8 days of the invoice date. Payments made after this period will attract atonement of 20 % with a minimum of 250 £ and interest of 1.5% per month or part thereof. Protest against invoices must reach us no later than 8 days of the invoice date.

6. Published Images.

OWI always requests at least two copies of any publication featuring OWI material.

7. Model Release

Whilst OWI or its suppliers shall use all reasonable endeavours to ensure that the material supplied will not violate the copyright of any third party and not defame or libel any person, the licensee is responsible for clearing all necessary permissions from third parties, be they people, buildings, art, which may include trademarks, personality rights, property rights, fine art rights, etc. The licensee shall indemnify and hold OWI harmless against any and all claims, liability, damages, costs, and expenses (including reasonable legal fees and expenses) arising out of the use of any feature.

8. Supply of transparencies

Images in transparency format will be sent to the licensee by post or courier. Transparencies are supplied on loan for one month and should be returned by the date stated on the delivery note. Should you require the images for a longer period you should need to contact us to arrange an extension.

Transparencies must be returned to OWI by a safe method, which affords proof of delivery. You must arrange adequate protection for transparencies in transit. You must enclose a delivery note detailing and totalling the returned Images and must send a copy of that note by email. Loss and damage will be charged.
